Terms & Conditions, and General Information By confirming a holiday booking with Time to Ski, you accept you have read and understood the Terms & Conditions as shown below, and agree to be bound by them. Please take time to read these terms in full. 1. The Booking Contract The booking contract is between Time to Ski (Company N° 833 409 006), Apt E503 La Chapelle - L'Etoile des Cimes, 73640 Sainte-Foy-Tarentaise, France (referred to as ”we, us, our”) and all persons named on your booking (referred to as “you, your, client, guest”). Please note that no contract will be made between you and us where a provisional booking or reservation enquiries are made and not supported by your payment of the deposits in full, and our issuing you with a booking confirmation. The person who completes your booking and who pays your deposit does so as agent for all persons named on it and by doing so warrants that he/she has authority to sign on behalf of all persons named on the booking form and acknowledges that these terms and conditions apply to all such persons. If you have any questions about the information contained in either these terms and conditions or your booking confirmation email, please do not hesitate to contact us as soon as possible so that we can resolve your query. Please refer to our website, www.timetoski.com for detailed descriptions of your accommodation. Making Your Booking To make an enquiry for general information, please contact us by telephone, or send us an email using our online enquiry form. To make a booking, please use our online sales tool. Where your booking is provisional only (i.e. you have not paid the deposits in full), we may hold an option (at our sole discretion) on that provisional booking for up to 24 hours (unless otherwise agreed by us in writing). If you have not confirmed your booking within 24 hours, we may sell the apartment you have provisionally booked to third parties and cancel your option without further notice. It is not always possible to hold options on late availability prices. In some cases it may not be possible for you to book online and in such cases telephone and email enquires will, on payment of the relevant deposit, be deemed to be offers by you which are subject to acceptance by us, on receipt by you of our booking confirmation email. When you receive our booking confirmation email, your booking will be subject to these terms and conditions. The lead name must be over 18 years of age and as signatory for this booking is confirming that they have read and agreed to the booking terms and conditions set out in this document and is liable for full payment of the booking on behalf of any guests in their party. Time to Ski will only communicate with, and take instruction from, the booking lead name who will be identified by you at the time of booking. It is then the group party leader’s responsibility to pass on any relevant information to other members of your group and to ensure that all members of your group are adequately insured. Your Holiday The services that form part of your holiday will be provided either directly by us, or by independently contracted suppliers. Unless stated otherwise, the price of your holiday will include: accommodation at the apartment named in your booking confirmation email, all local resort taxes, and Value Added Tax. Not included in the price of your holiday, unless stated otherwise is: any food or meals, your transport to and from the resort, your lift pass, any equipment hire, and holiday insurance. (Lift passes can be arranged so that they are waiting for you upon arrival, and we can assist you with your equipment hire at a Time to Ski discounted rate). 2. Payment & Confirmation By making a booking whether by telephone, online or in person you are making an offer to purchase the facilities and services requested, which will only be deemed accepted by us when all deposits have been fully paid and we issue your booking confirmation. The resulting contract is deemed to be made on the terms of these booking conditions, and is governed by and construed in accordance with French law. Prices All our holidays advertised on our website or otherwise are subject to availability and the price on the day of booking. How to Pay Full instructions for how to make your payment can be found on our online booking service by clicking on the “Book now” button. Deposit To confirm your booking we must receive a non-refundable deposit of 25% of the total price (or €300/week minimum). However, if you are arriving within 12 weeks of your booking date, then full payment will be due. You will then receive a confirmation of your booking. Balance The balance of the cost of your holiday is payable 12 weeks prior to arrival. We will contact you prior to this date to remind you that the balance is due. If the balance is not received by the due date, then we reserve the right to cancel the booking and retain your deposit. Payment can be made by credit card, or by bank transfer. We cannot be held responsible for any additional charges made by your credit card company or bank. There are no other booking or administration charges applicable with booking. Payment by any of these methods confirms your agreement and acceptance of our Terms and Conditions by you and all members of your group. Damage / Security Deposit A damage deposit for self catered accommodation will be payable one calendar month before arrival date. This deposit is fully refundable 14 days after your departure from the apartment, less any repair/replacement costs as a result of damage caused by anybody in your party. If costs exceed the damage deposit you will be liable for any outstanding balance. You will then be provided with photographic proof of damages, untidiness and/or uncleanliness, and an invoice for repairs/cleaning but this may take longer to arrange depending on cleaner & owner response. We will keep you informed throughout the process and refund your remaining security deposit as soon as possible. Please notify us within 24 hours of arrival if you find any damage, significant stains, uncleanliness, missing or stolen items otherwise it may be assumed you are responsible. If you cause any damage, breakages or stains and/or remove or allow any items to be removed or stolen (by leaving windows or doors unlocked for example) please notify us immediately as you are liable. Cleaning is normally included, but you are required to leave the property in a clean and tidy state. If you don’t, you may be liable for a cleaning surcharge. Any charges not covered by a security deposit will be paid by you within 14 days of notification. Any costs, including administration and legal expenses, involved in us collecting any outstanding charges after 14 days will also be paid by you. 3. Alteration Alteration by you In certain cases it may be possible to transfer your booking to another week, in the same apartment, or another of our properties. This will be at our absolute discretion, and in any case subject to availability and the payment of any price differential. It is the client’s responsibility to ensure that they have appropriate insurance cover in place for the unlikely event of having to cancel their holiday due to lift or piste closure. Time to Ski shall have no obligation, financial or otherwise, to compensate the client, or to arrange alternative accommodation in such circumstances. Time to Ski does not accept responsibility for the decisions or actions of the Sainte Foy lift company, Sainte Foy Tarentaise Loisirs Développement. Where you book your holiday and a booking confirmation is sent, we will not retrospectively refund you where we subsequently alter our prices on advertising a special offer. Alteration by us If your chosen accommodation becomes uninhabitable it may be necessary, or prudent, for Time to Ski to change your intended accommodation, and we reserve the right to do so. We will always do our utmost to find you equal or better accommodation. Unless any changes made are major changes, or your holiday is cancelled, you agree that you are not entitled to compensation. There are no circumstances in which we are liable for any consequential losses whatsoever such as (but not limited to) losses of holiday entitlement, loss of earnings, or the cost of onward flights or other transport or activity arrangements. For the avoidance of doubt no compensation is offered to you in such circumstances nor will it be payable by us. 4. Cancellation Cancellation by Time to Ski In the unlikely event we have to cancel or alter your confirmed booking, you have the option to take any superior accommodation offered by us, or cancel your booking; or accept a holiday in accommodation of a lower standard to that booked, together with a refund of the difference in price, if such accommodation is available. If you cancel under this provision, we will refund the full amount you have paid to us, and this will be our only liability. Force Majeure. If your holiday is altered or can’t be taken due to events, which may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control, we cannot accept liability, nor make refunds or pay compensation. You will be expected to claim on your insurance for a full refund of all monies paid. This is also applicable to the cancellation of transfers where the roads have been damaged, closed or deemed unsafe by local authorities; or vehicles unavailable or unsafe. Time to Ski shall have no responsibility or legal liability to compensate the client for loss of opportunity to take up the holiday. Cancellation by the client A cancellation by a client will only be effective once notification has been received in writing, by Time to Ski. This can be via email, or recorded mail to our Sainte Foy office. We reserve the right to levy a cancellation charge on the following basis. If the cancellation is made more than 12 weeks before arrival: the deposit will be forfeited. If the cancellation is made less than 12 weeks before arrival, the following levels of refund will apply: 50% between 12 and 8 weeks before arrival 25% between 8 and 4 weeks before arrival 0 %within 4 weeks of arrival We strongly recommend that you ensure that your insurance policy covers you against irrecoverable cancellation costs. If no written notice of cancellation is received and the client does not travel, cancellations will be deemed to have been received on the day of arrival. Time to Ski reserves the right to resell any part of the cancelled holiday, and this shall in no way alter their right to levy cancellation charges. Security deposits are not included and will be refunded in full, unless there are any outstanding charges. 5. Insurance It is a condition of booking that all clients must have appropriate and adequate insurance. This insurance must cover all activities that the client might undertake, offering cover for (but not limited to) public liability, property damage to the Apartment and its contents, and cancellation of the holiday. Medical treatment overseas and the cost of repatriation in the event of an emergency can be very expensive and it is therefore vital that you and your party are adequately insured. In the event of illness during your holiday it is your responsibility to pay all doctor’s fees, hospital expenses and repatriation expenses and we shall not be liable for any refund, either partial or total, of costs incurred by you. All guests are reminded that they are required to hold valid winter sports holiday insurance for their stay, if they are taking part in winter sports activities. Time to Ski accepts no responsibility for any costs that you or anyone in your party may incur as a result of failing to take out appropriate insurance. Acceptance and payment for any rental of our properties is confirmation by you, that you and all your party are adequately insured. 6. Data Protection Time to Ski takes responsibility for the suitable protection of your personal information provided to us. For further information please see our Privacy Policy on this website. 7. General Information Pets Pets shall not be permitted in any Time to Ski property, with the exception of those properties which are specifically identified as “Pet-Friendly”. The Client shall accept full responsibility for their pet whilst in Time to Ski accommodation, and accepts that they will be liable for any damage to the property or its contents, beyond that considered to be reasonable wear and tear, as a result of the behaviour of their pet during their stay. Check-in Time Your apartment will be ready from 16.00 on the day of your arrival. Please keep us informed of your expected arrival time. Check-out Time You must check-out of your apartment by 10.00 on your day of departure. Please keep us informed if you are planning to leave earlier. Check-in and Check-out times are set so that we can clean and prepare the apartments, and for this reason must be adhered to. Accommodation The number of people permitted to stay in your accommodation is strictly limited to the number of beds booked, as set out on the booking confirmation email. Subletting, sharing, or assignment is not allowed, although prior to arrival changes may be able to be made by contacting us. No Smoking All properties are non-smoking. General Safety Please take time to familiarise yourself with the general layout of the property, and especially the location of the emergency fire exits, escape routes, and congregation points. Outdoor Shoes Outdoor shoes, ski boots, or snowboard boots are not to be worn inside the apartment. Please ensure that you travel with suitable indoor footwear. WiFi WiFi is available in all our apartments. We will make all reasonable endeavours to ensure that this free service available 24 hours a day. However, broadband coverage in the Alps can be, and often is, unreliable. We will not be liable if for any reason the service is not available, at any time, or for any period. WiFi Disclaimer You accept that your use of the service is at your own risk. Time to Ski accepts no responsibility for the speed of the service, nor any interruptions, nor the security of the service. Time to Ski hereby exclude all and any warranties or conditions of any kind, whether express or implied, in respect of the service and any content or data obtained or downloaded from it. Lost Property Whilst we will do everything possible to help you locate your lost property; we cannot guarantee to find it. If (after your departure) we are able to locate your lost property and arrange for its return to you, we will ask that you pay the costs of doing so in advance. Where transit is arranged by us, we cannot be held responsible for loss of or damage to your lost property whilst in transit. General With respect to the general conditions covering occupancy levels set out in the booking form, pets and smoking, please ensure you check the property details carefully when booking as we reserve the right to cancel your holiday with no refund or liability if any of the specified requirements are not understood or complied with. 8. Accuracy of Information We try hard to ensure you are provided with honest and accurate information on our website and in all written and verbal communications but we do sometimes have to rely on other parties. Unfortunately errors and omissions can also occur and descriptions are subjective, so please check with us if there is any part of your holiday which is of particular importance and/or you feel there is, or may be a risk of, inaccurate information. We reserve the right to correct any errors if a genuine mistake has been made in our contract with you. 9. Nuisance by the Client In circumstances where the actions of you, or your visitors, are reasonably deemed by Time to Ski to be extreme, including significant damage, significant antisocial behaviour or illegal activities; Time to Ski reserves the right to cancel the holiday forthwith and eject the clients from our properties without compensation, and will have no liability to make any refund or pay any amounts in respect of that termination. 10. Breakdowns, Disruption, or if Accommodation becomes unfit for habitation. Please immediately report to us any breakdown in equipment, defects or lack of public services, and arrangements for repair or replacement will be made as soon as possible. However we shall not be liable to you for any temporary defects or stoppage in the supply of public services to the properties, nor in respect of any breakdown of equipment, machinery or appliance. If the Accommodation is or becomes unfit for habitation you must stay in contact with us and allow us reasonable time to access, organise repair or find appropriate alternate accommodation before making alternate arrangements. 11. Nuisance by the Client All clients undertake to behave in a responsible manner such that they in no way to cause damage, distress, danger or annoyance to other clients, property and/or any third party. The contract of any client in breach of this clause shall be terminated forthwith and Time to Ski shall have no further contractual obligations. Personal Property Time to Ski will not accept any liability for loss or damage to personal property. In the event of a loss, you would be expected to make a claim under your travel insurance policy. Time to Ski accepts no responsibility for any loss, delay or additional costs incurred due to adverse weather conditions. Personal Risk All clients agree that skiing is a hazardous and dangerous activity and that whether they are skiing on their own, or with a qualified guide or ski instructor, clients are voluntarily exposing themselves to risk of accident, damage, death, loss and/or personal injury, and in so doing participate strictly at their own risk. All clients agree that they will not hold Time to Ski responsible for any personal injury to a client (including death or disability) or damage to a client's property caused as a result of a client's decision to go skiing. Swimming Pool & Spa Facilities Guests using these facilities, do so at their own risk and Time to Ski can accept no responsibility for any accidents or injuries sustained. Children must be supervised at all times. Limitation of Liability If we are found liable on any basis whatsoever our maximum liability to you is the price of your holiday booking. 12. Third Party Services We may recommend or book lift tickets, nanny & child minding services, ski schools, instructors, transfer services, etc. for you. However you must make your own enquiries as to the qualifications, credentials, insurance and overall suitability of any of the services and we accept no responsibility in regard to the security or performance of these services. Bookings for extra services, such as taxis, excursions and ski lessons, made on your behalf by Time to Ski are subject to the terms and conditions laid down by the provider of the service and additional terms which may be laid down by Time to Ski. Time to Ski does not warrant the standard or performance of any extra services. You take full responsibility for satisfying yourself as to the quality and the provider’s ability to execute the services in advance and will address any grievance about the extra services by approaching the respective provider(s) directly. Lift Passes If arranged through us, your lift passes will be delivered to you/your accommodation on your arrival in resort. Please ensure that you check your passes and that they are what you ordered. Please ensure that all members of your party use their own lift pass (as labelled). Failure to do so may result in seizure or cancellation of your pass by the lift pass company. If you lose a pass please contact us immediately and we will provide you with a proof-of-purchase voucher to allow you to obtain a replacement from the lift pass company. Please note, we are unable to issue replacement passes. Complaints Holidays Are Important. We understand the stress and sometimes difficulty of getting your holiday right and the disappointment if things don’t go as expected, so please tell us politely if you have a problem and allow us the opportunity of resolving it quickly for you during your holiday. Failing to notify us immediately may affect your rights under this contract, as we will have been deprived of the opportunity to investigate and rectify your issue at the time of its occurrence. 14. Law & Jurisdiction Legal We do not make any warranties and/or representations, express or implied, as to the accuracy or validity of the information contained on our website. Nor do we make any warranties and/or representations as to the nature or standard or otherwise of any services offered on or through this site. We do not accept liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of: your use of or reliance on any content available on or through this site; any failure to access or delay in accessing this site; or the performance or non-performance of any services by us. Our liability shall be limited in respect of direct loss (save in the case of personal injury or death) to a maximum of the price of the product or service to which the claim relates. If any of the above limitations and exclusions, in whole or in part, are found to be unlawful, void or for any other reason unenforceable, that exclusion or part thereof shall be deemed severable and shall not affect the validity or enforceability of the other exclusion(s) or part(s) thereof in question. Law and Jurisdiction The contract, booking conditions and any matters arising from them are subject to, and governed by French law No liability can be accepted for any complaint not advised to us in a timely manner, in writing to Time to Ski.
